2. İşlenen Kişisel Veriler

Reflara'nın kendine ait bir sunucusu yoktur ve hesap gerekmez. İşlenen kişisel veriler, abonelik kontrolü için abonelik altyapısı sağlayıcımızın işlediği sınırlı verilerle ve bize kendiniz e-posta gönderdiğinizde işlenen verilerle sınırlıdır:

Önemli: Çektiğiniz fotoğraf ve videolar cihazınızda işlenir ve fotoğraf kitaplığınıza kaydedilir; Reflara bunları hiçbir sunucuya yüklemez veya göndermez. 3. İşlenme Amaçları ve Toplama Yöntemi

Amaçlar:

  • Uygulama açıldığında, yeniden öne geldiğinde ve abonelik ekranı açıldığında, abone olsanız da olmasanız da, size sunulan abonelik seçeneklerinin ve fiyatlarının gösterilmesi ve Reflara Pro durumunuzun kontrol edilmesi
  • Apple App Store üzerinden yapılan Reflara Pro satın alımının doğrulanması
  • Satın alımların talebiniz üzerine başka cihazda geri yüklenmesi
  • Abonelik ve satın alma istatistiklerinin abonelik altyapısı sağlayıcımız aracılığıyla görülmesi
  • Bize gönderdiğiniz e-postaların yanıtlanması, bildirdiğiniz sorunların incelenmesi ve KVKK kapsamındaki başvurularınızın sonuçlandırılması

Toplama yöntemi: Fotoğraflarınız ve videolarınız tarafımızca toplanmaz. Abonelikle ilgili veriler uygulama aracılığıyla otomatik elektronik yollarla toplanır ve Apple App Store ile abonelik altyapısı sağlayıcımız üzerinden işlenir. Destek yazışmaları, bize gönderdiğiniz e-posta ile elektronik yolla toplanır.

4. Hukuki Sebepler (KVKK m. 5/2)

  • m. 5/2-c — Bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması: satın alma öncesinde abonelik seçeneklerinin ve fiyatlarının gösterilmesi, Reflara Pro satın alımının yapılması ve satın aldığınız aboneliğin sağlanması.
  • m. 5/2-f — Meşru menfaatimiz: satın alımların doğrulanması ve geri yüklenmesi; abonelik ve satın alma istatistiklerinin görülmesi; bize gönderdiğiniz destek e-postalarının yanıtlanması.
  • m. 5/2-ç — Hukuki yükümlülüğümüzün yerine getirilmesi: KVKK m. 11 kapsamındaki başvurularınızın sonuçlandırılması.

Bölüm 2'de sayılan abonelik verileri adınızı veya e-postanızı içermez; ancak kullanıcı tanımlayıcısı, cihaz tanımlayıcısı ve IP adresi nedeniyle takma adlı kişisel veri sayılır. Bu sınırlı işleme açık rızaya dayanmaz; yukarıda belirtilen sözleşmenin kurulması veya ifası, meşru menfaat ve hukuki yükümlülük sebeplerine dayanır.

5. Kişisel Verilerin Aktarılması

Yurt içi aktarım: Yok.

Yurt dışı aktarım: Abonelik kontrolü ve destek e-postalarıyla sınırlıdır. Bölüm 2'de sayılan abonelik verileri, yurt dışında (ABD) yerleşik abonelik altyapısı sağlayıcımız tarafından bu metinde belirtilen amaçlarla işlenir. Bu aktarım, satın alma yapıp yapmadığınızdan bağımsız olarak şu durumlarda gerçekleşir: uygulama açıldığında, yeniden öne geldiğinde ve abonelik ekranı açıldığında; ayrıca satın alma ve geri yükleme sırasında ve aboneliğinizle ilgili bir App Store işlemi (örneğin yenileme) uygulama açıkken algılandığında. İzleme izninin durumunu gösteren değer, uygulama arka plana geçerken de iletilebilir. Destek e-postaları, e-posta hizmet sağlayıcımızın yurt dışındaki sunucularında işlenebilir. Hizmet sağlayıcılarımızın adlarını ve gizlilik politikalarını, KVKK m. 11/1-(ç) kapsamında contact@lesmazer.com adresinden talep edebilirsiniz.

Ödeme Apple App Store tarafından yürütülür (Apple'ın gizlilik politikası kapsamında). Reflara fotoğraflarınızı ve videolarınızı hiçbir sunucuya göndermez.

6. Veri Güvenliği (KVKK m. 12)

Teknik tedbirler: Reflara'nın cihazınızda tuttuğu veriler, işletim sisteminin her uygulamaya ayırdığı ve diğer uygulamaların erişemediği alanda tutulur. Abonelik altyapısı sağlayıcımızla iletişim şifreli bağlantı ile sağlanır.

7. Kişisel Verilerin Saklanma Süreleri

  • Fotoğraflarınız ve videolarınız: Fotoğraf kitaplığınızda, sizin kontrolünüzde tutulur; tarafımızca saklanmaz. Uygulamayı kaldırmanız, Reflara'nın cihazınızda tuttuğu verileri kaldırır; ücretsiz ÇİFT kullanım sayacı ise cihazınızın güvenli depolama alanında kalır (yalnızca bir sayıdır, bize gönderilmez).
  • Kullanıcı tanımlayıcısı ve abonelik durumu: Cihazınızdaki kopyaları uygulamayı kaldırdığınızda silinir; cihaz yedeklerindeki kopyalar yedekleme ayarlarınıza tabidir.
  • Abonelik verileri ve satın alma kayıtları: Bölüm 2'de sayılan abonelik verileri ile Apple App Store ve abonelik altyapısı sağlayıcımız nezdindeki abonelik/satın alma kayıtları, ilgili sağlayıcıların saklama politikalarına tabidir. Bu kayıtların silinmesini contact@lesmazer.com adresinden talep edebilirsiniz.
  • Destek yazışmaları: Talebiniz sonuçlandıktan sonra en fazla 12 ay saklanır, ardından silinir.

8. İlgili Kişinin Hakları (KVKK m. 11)

KVKK madde 11 kapsamında veri sahibi olarak aşağıdaki haklara sahipsiniz:

  1. (a) Kişisel verilerin işlenip işlenmediğini öğrenme,
  2. (b) İşlenmişse buna ilişkin bilgi talep etme,
  3. (c) İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,
  4. (ç) Yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme,
  5. (d) Eksik veya yanlış işlenmişse düzeltilmesini isteme,
  6. (e) KVKK madde 7 çerçevesinde silinmesini veya yok edilmesini isteme,
  7. (f) (d) ve (e) bentleri uyarınca yapılan işlemlerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  8. (g) Otomatik sistemler vasıtasıyla analiz edilmesi sonucu kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
  9. (ğ) Kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme.

9. Başvuru Yöntemi

Yukarıdaki haklarınızı kullanmak için kimliğinizi tespit edici bilgiler ve talebinizle birlikte contact@lesmazer.com adresine e-posta gönderebilirsiniz.

Başvurularınız 30 gün içinde ücretsiz olarak sonuçlandırılır (Kurul tarafından belirlenen ücret tarifesi ayrıca geçerli olabilir). Başvurunuza yanıt alamamanız veya yanıttan tatmin olmamanız hâlinde Kişisel Verileri Koruma Kurulu'na şikâyette bulunabilirsiniz.

10. Çocukların Verisi

Reflara, 13 yaşın altındaki çocuklardan bilerek kişisel veri işlemez. Uygulamada yaş sorulmaz; abonelik kontrolü için Bölüm 2'de sayılan takma adlı veriler tüm kullanıcılar için işlenir. Veli veya vasi, bir çocuğa ait olduğunu düşündüğü verilerle ilgili talepleri için contact@lesmazer.com adresine başvurabilir.

11. Aydınlatma Metninde Değişiklikler

Bu metin gerek gördükçe güncellenir. Güncelleme tarihi sayfanın üst kısmında belirtilir. Önemli değişiklikleri görmek için bu sayfayı periyodik olarak gözden geçirmeniz önerilir.

2. Personal Data Processed

Reflara has no server of its own and needs no account. The personal data processed is limited to the data our subscription infrastructure provider processes to check your subscription and the data processed when you email us yourself:

Important: The photos and videos you take are processed on your device and saved to your photo library; Reflara never uploads or sends them to any server. We do not process this content as personal data and have no access to it. For device backups, the photo library and sharing, see the Privacy Policy.

3. Purposes of Processing and Collection Method

Purposes:

  • Showing the subscription options and prices available to you and checking your Reflara Pro status when the app opens, when it returns to the foreground and when the subscription screen opens, whether or not you subscribe
  • Verifying a Reflara Pro purchase made through the Apple App Store
  • Restoring purchases on another device at your request
  • Seeing subscription and purchase statistics through our subscription infrastructure provider
  • Answering the emails you send us, looking into the issues you report and handling your applications under the KVKK

Collection method: We do not collect your photos or videos. Subscription-related data is collected automatically by electronic means through the app and processed through the Apple App Store and our subscription infrastructure provider. Support correspondence is collected electronically through the email you send us.

4. Legal Grounds (KVKK Art. 5/2)

  • Art. 5/2-c — Directly related to the establishment or performance of a contract: showing the subscription options and prices before purchase, making a Reflara Pro purchase and providing the subscription you buy.
  • Art. 5/2-f — Our legitimate interest: verifying and restoring purchases; seeing subscription and purchase statistics; answering the support emails you send us.
  • Art. 5/2-ç — Compliance with our legal obligation: handling your applications under KVKK Art. 11.

The subscription data listed in Section 2 does not include your name or email; however, because of the user identifier, the device identifier and the IP address, it counts as pseudonymous personal data. This limited processing does not rely on explicit consent; it relies on the establishment or performance of a contract, legitimate interest and legal obligation, as stated above.

5. Transfer of Personal Data

Transfers within Türkiye: None.

Transfers abroad: Limited to the subscription check and support emails. The subscription data listed in Section 2 is processed by our subscription infrastructure provider, which is based abroad (United States), for the purposes stated in this notice. Whether or not you have made a purchase, this transfer happens when the app opens, when it returns to the foreground and when the subscription screen opens, and also during a purchase or a restore and when a subscription-related App Store transaction (such as a renewal) is detected while the app is open. The value showing the status of the tracking permission may also be sent when the app goes to the background. Support emails may be processed on our email service provider's servers abroad. You can request the names and privacy policies of our service providers at contact@lesmazer.com under KVKK Art. 11/1-(ç).

Payment is handled by the Apple App Store (under Apple's privacy policy). Reflara never sends your photos or videos to any server.

6. Data Security (KVKK Art. 12)

Technical measures: The data Reflara keeps on your device is kept in the area the operating system sets aside for each app, which other apps cannot access. Communication with our subscription infrastructure provider uses an encrypted connection.

7. Retention Periods

  • Your photos and videos: kept in your photo library and under your control; we do not store them. Removing the app deletes the data Reflara keeps on your device; the free DUAL use counter, however, stays in your device's secure storage (it is only a number and is never sent to us).
  • User identifier and subscription status: The copies on your device are deleted when you remove the app; copies in device backups follow your backup settings.
  • Subscription data and purchase records: The subscription data listed in Section 2 and the subscription and purchase records held by the Apple App Store and our subscription infrastructure provider are subject to those providers' retention policies. You can ask for these records to be deleted at contact@lesmazer.com.
  • Support correspondence: Kept for up to 12 months after your request is resolved and then deleted.

8. Your Rights as a Data Subject (KVKK Art. 11)

Under Article 11 of the KVKK, as a data subject you have the right to:

  1. (a) learn whether your personal data is processed,
  2. (b) request information about it if it has been processed,
  3. (c) learn the purpose of the processing and whether the data is used for that purpose,
  4. (ç) know the third parties in Türkiye or abroad to whom it is transferred,
  5. (d) request its correction if it is incomplete or inaccurate,
  6. (e) request its deletion or destruction under Article 7 of the KVKK,
  7. (f) request that the actions taken under (d) and (e) be notified to the third parties to whom it was transferred,
  8. (g) object to a result against you that arises from analysis by automated systems,
  9. (ğ) claim compensation if you suffer damage because of unlawful processing.

9. How to Apply

To exercise the rights above, you can email contact@lesmazer.com with information that identifies you and your request.

Your applications are resolved free of charge within 30 days (the fee tariff set by the Board may also apply). If you receive no response or are not satisfied with the response, you can file a complaint with the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu).

10. Children's Data

Reflara does not knowingly process personal data of children under the age of 13. The app does not ask for your age; the pseudonymous data listed in Section 2 is processed for all users to check the subscription. A parent or guardian can contact contact@lesmazer.com with requests about data they believe belongs to a child.

11. Changes to This Notice

This notice is updated as needed. The update date is shown at the top of the page. We recommend reviewing this page periodically to see important changes.
